These Terms and Conditions (“Terms”) govern access to and use of the Early Birds website at https://fullstack.earlybirds.me/ and the digital learning platform, courses, exercises, examinations, certificates, AI-assisted features, and related services made available through it (together, the “Service”).

The Service is offered under the brand Early Birds and is operated on an independent, freelance (sole-operator) basis from Cairo, Egypt (“Early Birds”, “we”, “us”, or “our”). We operate as an individual freelance provider, not as a registered company.

By creating an account, purchasing access, clicking an acceptance checkbox, or using the Service, you confirm that you have read and agreed to these Terms and our Refund Policy.

If you do not agree, do not purchase or use the paid parts of the Service.

3. Eligibility and users under 18

The learning content may be suitable for learners from approximately 12 years of age. However, a person purchasing the Service or accepting these Terms must be at least 18 years old and legally capable of entering into a contract.

A learner under 18 may use the Service only with the consent and supervision of a parent or legal guardian. When a parent or guardian creates or purchases an account for a minor, that adult accepts these Terms and is responsible for the minor’s use of the Service.

4. Description of the Service

Early Birds provides a bilingual digital education platform in Arabic and English. Features may include interactive software-engineering modules, in-browser coding activities, quizzes and examinations, progress tracking, downloadable or printable completion certificates, deployment exercises, and an AI-assisted learning coach.

Descriptions, module counts, track counts, prices, promotional offers, and included features are those displayed on the website or checkout page at the time of purchase. We may improve, reorganize, replace, or update content while preserving the overall nature and value of the purchased program.

5. Accounts and security

You must provide accurate and current account information. Your account is personal, non-transferable, and may not be sold, rented, shared publicly, or used to provide access to unrelated third parties.

Unless a different limit is shown on the purchase page, one account may be used on up to two personal devices. You are responsible for keeping login credentials confidential and for activity performed through your account. Notify us promptly if you suspect unauthorized access.

6. Prices and payment

Prices are displayed in Egyptian Pounds unless stated otherwise. The final price shown at checkout is the amount payable, including any applicable taxes or charges that we are legally required to disclose.

Paid access is generally sold as a one-time purchase and is not a recurring subscription unless the checkout page clearly states otherwise. Payment may be processed by a third-party payment gateway, including Kashier, or by mobile wallet / instant transfer. Payment-provider terms and privacy notices may also apply to the payment transaction.

We do not guarantee that every payment method will be available at all times. Access is activated after successful payment confirmation or according to the instructions shown at checkout.

7. Access and meaning of “lifetime access”

Where a purchase is advertised as “lifetime access,” it means access without recurring course fees for the operational lifetime of the purchased Early Birds program on our platform. It does not mean the biological lifetime of a user and does not guarantee that the platform will operate indefinitely.

We will use reasonable efforts to maintain the Service. We may suspend access temporarily for maintenance, security, legal compliance, or circumstances outside our reasonable control. If the Service is permanently discontinued and mandatory law requires a remedy, we will provide the remedy required by that law.

8. Refunds and cancellation

Refunds are governed by our Refund Policy, which forms part of these Terms. The website currently offers a seven-day money-back guarantee for eligible purchases. Nothing in these Terms limits any mandatory consumer right that applies under Egyptian law.

Because paid access is a one-time digital-service purchase rather than a recurring subscription, there is normally no recurring plan to cancel. A refund, when approved, ends paid access to the refunded program.

9. Limited license and intellectual property

All course text, translations, graphics, interfaces, code examples, question banks, examinations, software, platform features, trademarks, and other materials supplied through the Service are owned by or licensed to Early Birds and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own learning. You may create and own original code and projects that you independently develop while learning, except for Early Birds materials embedded in them.

You must not, without written permission:

10. Acceptable use

You must use the Service lawfully and respectfully. You must not use it to commit fraud, violate another person’s rights, distribute malware, interfere with the platform, attempt unauthorized access, submit unlawful or harmful content, impersonate another person, manipulate examinations, or misuse payment systems.

We may investigate suspected abuse and take reasonable protective action, including limiting features, resetting credentials, suspending access, preserving relevant records, or reporting unlawful activity where required.

11. AI-assisted features

The Service may include an AI learning coach or other automated features. AI-generated responses can be incomplete, inaccurate, or unsuitable. They are learning aids and are not professional, legal, financial, medical, cybersecurity, or employment advice.

Do not submit passwords, payment-card data, government identifiers, confidential business information, or other highly sensitive information to AI features. You remain responsible for reviewing and testing code, answers, and decisions before relying on them.

12. Examinations and certificates

Certificates issued through the Service confirm completion or performance within the Early Birds platform only. Unless expressly stated otherwise, they are not university degrees, professional licenses, government accreditation, or guarantees of admission, employment, income, or professional competence.

Cheating, impersonation, unauthorized collaboration, question sharing, or technical manipulation may result in cancellation of an examination result or certificate and suspension of access.

13. User content and projects

You retain ownership of original code, text, and project materials that you submit to the Service. You grant us a limited, non-exclusive license to host, process, display, and technically reproduce that content only as needed to provide, secure, support, and improve the Service.

You confirm that your submitted content is lawful and does not infringe third-party rights. Do not submit content that you are not authorized to use.

14. Third-party services and external links

The Service may rely on or link to third-party services such as payment gateways, cloud platforms, domain providers, code tools, or external documentation. Those services are governed by their own terms and privacy policies. We are not responsible for third-party services that we do not control, but this does not exclude any responsibility that cannot legally be excluded.

15. Privacy

We collect only the data needed to provide the Service — your account email, your learning progress, and confirmation that a payment succeeded. We do not store payment-card numbers; card and wallet data is processed directly by the payment gateway and relevant financial institutions. We do not sell your personal data. 16. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary because of a material breach of these Terms, account sharing, fraud, security risk, unlawful use, chargeback abuse, non-payment, or a legal or payment-network requirement.

Where reasonably possible, we will notify you and allow an opportunity to resolve the issue. Immediate action may be taken where needed to protect users, systems, payment integrity, or legal compliance. Sections that by their nature should survive termination will remain effective.

17. Service disclaimers

We aim to provide useful and accurate educational content, but learning outcomes depend on many factors, including the learner’s effort and prior knowledge. We do not guarantee a particular examination score, skill level, job, freelance project, income, client, admission, or business outcome.

The Service is provided using reasonable skill and care. Except for rights and warranties that cannot legally be excluded, the Service is provided on an “as available” basis, and temporary errors, interruptions, or incompatibilities may occur.

18. Limitation of liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for fraud, gross negligence, or mandatory consumer rights.

To the maximum extent permitted by law, Early Birds will not be liable for indirect or consequential losses, loss of profits, loss of opportunity, or loss caused by a user’s failure to secure credentials, misuse of third-party tools, or reliance on unverified AI output.

Where liability may lawfully be limited, our total liability arising from a paid purchase will not exceed the amount actually paid for that purchase. This limitation does not apply where mandatory law requires a greater remedy.

19. Changes to the Service or Terms

We may update these Terms to reflect legal, security, operational, payment, or product changes. The updated version will be posted with a new “Last updated” date. Changes will not retroactively remove a refund right or other mandatory right that had already arisen.

20. Governing law and disputes

These Terms are governed by the laws of the Arab Republic of Egypt. We encourage you to contact us first so that we can try to resolve any complaint promptly. Nothing in these Terms prevents a consumer from contacting the Egyptian Consumer Protection Agency or exercising any right before a competent authority or court. Subject to mandatory consumer-jurisdiction rules, disputes will be submitted to the competent Egyptian courts.

21. General provisions

If any provision is found invalid or unenforceable, the remaining provisions remain effective. A delay in enforcing a right does not waive that right. You may not transfer your account or contractual rights without our written consent, except where the law permits otherwise. These Terms and the Refund Policy form the agreement relating to your purchase and use of the Service.

22. Language

These Terms are provided in Arabic and English. Both versions are intended to have the same meaning. If there is a conflict or ambiguity, the Arabic version will prevail to the extent permitted by law.

الشروط والأحكام

تنظّم هذه الشروط والأحكام ("الشروط") الدخول إلى موقع Early Birds على الرابط https://fullstack.earlybirds.me/ واستخدام منصة التعلّم الرقمية والدورات والتمارين والاختبارات والشهادات والخصائص المدعومة بالذكاء الاصطناعي والخدمات المرتبطة بها (ويُشار إليها مجتمعةً بـ"الخدمة").

1. بيانات مقدم الخدمة

تُقدَّم الخدمة تحت العلامة التجارية Early Birds، ويتم تشغيلها بصفة مستقلة كعمل حر (مشغّل فردي) من القاهرة، مصر (ويُشار إليه بـ"Early Birds" أو "نحن" أو "لنا"). نعمل بصفة فردية كمقدّم خدمة حر، ولسنا شركة مسجّلة.

2. الموافقة على الشروط

بإنشاء حساب أو شراء الوصول المدفوع أو تحديد مربع الموافقة أو استخدام الخدمة، فإنك تقر بأنك قرأت ووافقت على هذه الشروط وسياسة الاسترداد.

إذا لم توافق على هذه المستندات، فلا تشترِ أو تستخدم الأجزاء المدفوعة من الخدمة.

3. الأهلية والمستخدمون دون 18 عامًا

قد يكون المحتوى التعليمي مناسبًا لمتعلمين من سن تقارب 12 عامًا. ومع ذلك، يجب أن يكون الشخص الذي يشتري الخدمة أو يوافق على هذه الشروط قد بلغ 18 عامًا على الأقل ويتمتع بالأهلية القانونية للتعاقد.

يجوز للمتعلم دون 18 عامًا استخدام الخدمة فقط بموافقة وإشراف ولي الأمر أو الوصي القانوني. وعندما ينشئ ولي الأمر أو الوصي حسابًا لقاصر أو يشتريه له، فإنه يوافق على هذه الشروط ويتحمل مسؤولية استخدام القاصر للخدمة.

4. وصف الخدمة

تقدم Early Birds منصة تعليمية رقمية ثنائية اللغة بالعربية والإنجليزية. وقد تشمل خصائصها وحدات تفاعلية في هندسة البرمجيات، وتمارين برمجة داخل المتصفح، واختبارات، وتتبع التقدم، وشهادات إتمام قابلة للتنزيل أو الطباعة، وتمارين نشر المشروعات، ومدرب تعلم مدعوم بالذكاء الاصطناعي.

تكون أوصاف المحتوى وعدد الوحدات والمسارات والأسعار والعروض الترويجية والخصائص المشمولة وفقًا لما هو ظاهر على الموقع أو صفحة الدفع وقت الشراء. ويجوز لنا تحسين المحتوى أو إعادة ترتيبه أو استبداله أو تحديثه مع الحفاظ على الطبيعة والقيمة العامة للبرنامج الذي تم شراؤه.

5. الحساب وأمنه

يجب تقديم بيانات صحيحة ومحدثة. الحساب شخصي وغير قابل للتحويل، ولا يجوز بيعه أو تأجيره أو مشاركته علنًا أو استخدامه لمنح أشخاص غير مرتبطين بالمشتري وصولًا إلى المحتوى.

ما لم يظهر حد مختلف في صفحة الشراء، يجوز استخدام الحساب الواحد على جهازين شخصيين بحد أقصى. وتتحمل مسؤولية الحفاظ على سرية بيانات الدخول وكافة الأنشطة التي تتم من خلال حسابك. ويجب إبلاغنا فورًا عند الاشتباه في دخول غير مصرح به.

6. الأسعار والدفع

تُعرض الأسعار بالجنيه المصري ما لم يُذكر خلاف ذلك. ويكون السعر النهائي الظاهر عند الدفع هو المبلغ المستحق، شاملًا الضرائب أو الرسوم التي يوجب القانون الإفصاح عنها.

يُباع الوصول المدفوع عادةً بمقابل يُدفع مرة واحدة، ولا يمثل اشتراكًا متجددًا ما لم تنص صفحة الدفع بوضوح على خلاف ذلك. وقد تتم معالجة المدفوعات عن طريق مزود دفع خارجي، بما في ذلك كاشير (Kashier)، أو عبر محفظة إلكترونية أو تحويل فوري، وقد تسري شروط وسياسة خصوصية مزود الدفع على معاملة الدفع.

لا نضمن توافر جميع وسائل الدفع في كل وقت. ويتم تفعيل الوصول بعد تأكيد نجاح الدفع أو وفق التعليمات الظاهرة في صفحة الدفع.

7. الوصول ومعنى "وصول مدى الحياة"

عندما يوصف الشراء بأنه يتضمن "وصولًا مدى الحياة"، فالمقصود هو الوصول دون رسوم دورية للدورة طوال العمر التشغيلي لبرنامج Early Birds الذي تم شراؤه على منصتنا. ولا يعني ذلك العمر البيولوجي للمستخدم ولا يعد ضمانًا لاستمرار تشغيل المنصة إلى الأبد.

نبذل جهودًا معقولة للحفاظ على الخدمة. ويجوز تعليق الوصول مؤقتًا لأغراض الصيانة أو الأمن أو الامتثال القانوني أو بسبب ظروف خارجة عن سيطرتنا المعقولة. وإذا توقفت الخدمة نهائيًا وكان القانون الآمر يوجب علاجًا معينًا، فسنقدم ما يوجبه القانون.

8. الاسترداد والإلغاء

تخضع المبالغ المستردة لـسياسة الاسترداد التي تُعد جزءًا من هذه الشروط. ويعرض الموقع حاليًا ضمان استرداد الأموال خلال سبعة أيام للمشتريات المؤهلة. ولا تحد هذه الشروط من أي حق إلزامي للمستهلك بموجب القانون المصري.

ولأن الوصول المدفوع يمثل عادة شراءً لمرة واحدة لخدمة رقمية وليس اشتراكًا متجددًا، فلا يوجد في العادة اشتراك دوري يحتاج إلى الإلغاء. وعند الموافقة على الاسترداد، ينتهي الوصول المدفوع إلى البرنامج محل الاسترداد.

9. الترخيص المحدود وحقوق الملكية الفكرية

جميع نصوص الدورات والترجمات والرسومات والواجهات وأمثلة الأكواد وبنوك الأسئلة والاختبارات والبرمجيات وخصائص المنصة والعلامات التجارية وغيرها من المواد المتاحة من خلال الخدمة مملوكة لـEarly Birds أو مرخصة لها، وتحميها قوانين الملكية الفكرية المعمول بها.

مع الالتزام بهذه الشروط، نمنحك ترخيصًا محدودًا وشخصيًا وغير حصري وغير قابل للتحويل وقابلًا للإلغاء للوصول إلى الخدمة واستخدامها لأغراض التعلم الشخصي. وتظل مالكًا للأكواد والمشروعات الأصلية التي تطورها بنفسك أثناء التعلم، باستثناء مواد Early Birds المضمنة فيها.

ولا يجوز لك دون إذن كتابي: نسخ المحتوى أو بيعه أو إعادة نشره أو استغلاله تجاريًا؛ أو مشاركة المحتوى المدفوع أو لقطات الشاشة أو بيانات الدخول أو بنوك الأسئلة؛ أو جمع المحتوى آليًا أو تجاوز وسائل الحماية؛ أو استخدامه لتدريب منتج آخر؛ أو إزالة إشعارات الملكية.

10. الاستخدام المقبول

يجب استخدام الخدمة بصورة قانونية ومحترمة. ويحظر استخدامها في الاحتيال أو انتهاك حقوق الغير أو نشر البرمجيات الضارة أو تعطيل المنصة أو محاولة الدخول غير المصرح به أو التلاعب بالاختبارات أو إساءة استخدام أنظمة الدفع. ويجوز لنا التحقيق في إساءة الاستخدام واتخاذ إجراءات حماية معقولة.

11. الخصائص المدعومة بالذكاء الاصطناعي

قد تتضمن الخدمة مدرب تعلم بالذكاء الاصطناعي. وقد تكون الإجابات الناتجة ناقصة أو غير دقيقة، وهي أدوات مساعدة على التعلم وليست مشورة مهنية أو قانونية أو مالية أو طبية. لا ترسل كلمات مرور أو بيانات بطاقات أو معلومات حساسة إلى خصائص الذكاء الاصطناعي، وتظل مسؤولًا عن مراجعة الأكواد والقرارات قبل الاعتماد عليها.

12. الاختبارات والشهادات

تثبت الشهادات الصادرة الإتمام أو الأداء داخل منصة Early Birds فقط. وما لم يُذكر صراحةً خلاف ذلك، فهي ليست درجة جامعية أو ترخيصًا مهنيًا أو اعتمادًا حكوميًا، ولا تضمن القبول أو التوظيف أو الدخل. وقد يؤدي الغش أو التلاعب إلى إلغاء النتيجة أو الشهادة وتعليق الوصول.

13. محتوى المستخدم ومشروعاته

تحتفظ بملكية الأكواد والنصوص والمشروعات الأصلية التي ترسلها. وتمنحنا ترخيصًا محدودًا وغير حصري لاستضافتها ومعالجتها وعرضها بالقدر اللازم لتقديم الخدمة وتأمينها وتحسينها. وتقر بأن المحتوى الذي ترسله قانوني ولا ينتهك حقوق الغير.

14. خدمات الغير والروابط الخارجية

قد تعتمد الخدمة على خدمات خارجية مثل بوابات الدفع والمنصات السحابية وأدوات البرمجة. وتخضع تلك الخدمات لشروطها الخاصة. ولا نتحمل مسؤولية الخدمات التي لا نسيطر عليها، دون الإخلال بأي مسؤولية لا يجوز قانونًا استبعادها.

15. الخصوصية

نجمع فقط البيانات اللازمة لتقديم الخدمة — بريد حسابك، وتقدّمك في التعلم، وتأكيد نجاح الدفع. لا نخزّن أرقام بطاقات الدفع؛ فبيانات البطاقات والمحافظ تُعالَج مباشرة بواسطة بوابة الدفع والمؤسسات المالية. ولا نبيع بياناتك الشخصية. ولأي طلب يتعلق بالخصوصية (اطلاع أو تصحيح أو حذف) راسلنا على support@earlybirds.me.

16. التعليق والإنهاء

يجوز لك التوقف عن استخدام الخدمة في أي وقت. ويجوز لنا تعليق أو إنهاء الوصول عند الضرورة بسبب مخالفة جوهرية أو مشاركة الحساب أو الاحتيال أو مخاطر أمنية أو استخدام غير قانوني أو عدم السداد أو متطلبات قانونية. وحيثما أمكن سنخطرك ونمنحك فرصة للمعالجة. وتظل الأحكام التي تقتضي طبيعتها الاستمرار نافذة بعد الإنهاء.

17. إخلاء المسؤولية عن النتائج التعليمية

نسعى لتقديم محتوى مفيد ودقيق، إلا أن نتائج التعلم تعتمد على عوامل متعددة منها جهد المتعلم. ولا نضمن درجة اختبار أو مستوى مهارة أو وظيفة أو دخلًا أو نتيجة محددة. تُقدَّم الخدمة ببذل عناية معقولة وحسب توافرها، وقد تحدث أخطاء أو انقطاعات مؤقتة.

18. حدود المسؤولية

لا تستبعد هذه الشروط المسؤولية حيث يحظر القانون ذلك، بما في ذلك الاحتيال أو الخطأ الجسيم أو حقوق المستهلك الإلزامية. وبالقدر الأقصى المسموح قانونًا، لا نكون مسؤولين عن الخسائر غير المباشرة أو فقد الأرباح أو الخسائر الناتجة عن عدم حماية بيانات الدخول أو الاعتماد على مخرجات ذكاء اصطناعي غير متحقق منها. وحيثما يجوز قانونًا، لا تتجاوز مسؤوليتنا الإجمالية المبلغ المدفوع فعليًا عن عملية الشراء.

19. تعديل الخدمة أو الشروط

يجوز تحديث هذه الشروط لأسباب قانونية أو أمنية أو تشغيلية أو متعلقة بالدفع أو المنتج، ويُنشر الإصدار المحدث بتاريخ جديد. ولا تسري التغييرات بأثر رجعي لإلغاء حق استرداد أو حق إلزامي نشأ بالفعل.

20. القانون الواجب التطبيق والمنازعات

تخضع هذه الشروط لقوانين جمهورية مصر العربية. ونشجعك على التواصل معنا أولًا لحل أي شكوى. ولا تمنعك هذه الشروط من التواصل مع جهاز حماية المستهلك المصري أو ممارسة أي حق أمام جهة مختصة. ومع مراعاة قواعد الاختصاص الإلزامية، تختص المحاكم المصرية بنظر المنازعات.

21. أحكام عامة

إذا تبيّن بطلان أي حكم، تظل باقي الأحكام نافذة. ولا يعد التأخر في إنفاذ حق تنازلًا عنه. ولا يجوز نقل الحساب أو الحقوق دون موافقتنا الكتابية إلا حيث يجيز القانون. وتشكل هذه الشروط وسياسة الاسترداد الاتفاق المتعلق بشراء الخدمة واستخدامها.

22. اللغة

تتاح هذه الشروط بالعربية والإنجليزية بالمعنى نفسه. وعند وجود تعارض، تكون النسخة العربية هي المرجع بالقدر الذي يسمح به القانون.
